1. Acceptance of Terms

By accessing or using Capital Advantage ("the Platform"), operated by Advantage Analytics Private Limited ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and the Company.

2. Description of Service

Capital Advantage is a financial analytics platform that provides portfolio analytics, stock screening, risk analysis, and related tools for Indian equity markets. The Platform is designed for educational and informational purposes only.

Important: Capital Advantage is NOT registered with the Securities and Exchange Board of India (SEBI) as a Research Analyst (RA) or Investment Adviser (IA). Nothing on this Platform constitutes investment advice, recommendations, or solicitation to buy, sell, or hold any security.

3. User Accounts & Verification

To access certain features, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

As part of registration, you must verify your identity via a one-time password (OTP) sent to your mobile number or email address. By providing your mobile number, you consent to receiving transactional SMS messages from Capital Advantage (via MSG91) for OTP verification, security alerts, and subscription-related notifications. Standard SMS and data rates from your mobile carrier may apply. We will not send marketing or promotional messages via SMS without your separate opt-in consent.

4. User Responsibilities

• You must be at least 18 years of age to use the Platform.
• You will not use the Platform for any unlawful purpose.
• You will not attempt to gain unauthorized access to the Platform or its systems.
• You will not use automated tools to scrape or extract data from the Platform without permission.
• You are solely responsible for your investment decisions. The Platform does not provide personalized investment advice.

5. Subscription Plans & Payments

Capital Advantage offers free and paid subscription tiers. Paid plans ("Pro") are available on monthly and annual billing cycles. All prices are listed in Indian Rupees (INR) and are final. A payment receipt will be emailed to your registered address by Razorpay after each successful payment.

5.1. Billing & Auto-Renewal

• Paid subscriptions are recurring and will auto-renew at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date.
• Payment is processed through Razorpay, a PCI-DSS compliant third-party payment gateway. Capital Advantage does not store your card details, bank account numbers, or UPI IDs on its servers.
• You will be charged the then-current subscription fee at each renewal. We will notify you via email at least 15 days before any price increase takes effect on your next renewal.

5.2. Cancellation

• You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of your current billing period — you retain access to Pro features until then.
• No partial or prorated refunds are provided for unused portions of a billing period after cancellation.

5.3. No Refunds

All subscription payments are final and non-refundable. By subscribing, you acknowledge that no refunds will be issued for any reason, including partial or unused billing periods. We encourage you to explore the Platform's free tier before committing to a paid plan. 5.4. Payment Failures

If a recurring payment fails, Razorpay will retry the charge as per its retry policy. If all retry attempts fail, your subscription will be downgraded to the free tier. No penalty is charged for payment failures. You may resubscribe at any time.

5.5. Plan Changes

You may switch between monthly and annual plans at any time. When switching plans, your current subscription is cancelled and a new subscription begins immediately. No refund is issued for the remaining period of the cancelled plan.

6. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, analytics models, and software, are the property of Capital Advantage and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

7. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that data will be accurate or complete. Market data is sourced from third-party providers (including BSE, NSE, and TrueData) and may be delayed or contain errors.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Capital Advantage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment losses, arising from your use of the Platform. The Platform is not responsible for any investment decisions made based on information provided herein. Our total aggregate liability shall not exceed the subscription fees paid by you in the 12 months preceding the claim.

9. Data Protection

We process your personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and our Privacy Policy. By using the Platform, you consent to the collection and processing of your data as described in our Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the Settings page. Upon deletion, all your personal data and portfolio information will be permanently removed from our systems. If you have an active paid subscription at the time of account deletion, it will be cancelled and no refund will be issued for the remaining period.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India. Before initiating formal proceedings, both parties agree to attempt resolution through good-faith communication for a period of 30 days.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the Platform or via email at least 15 days before they take effect. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
